§ 28-3. Abandoned and derelict motor vehicles state provisions adopted by reference.

  • (a)

    Abandoned and derelict motor vehicles shall be defined and disposed of in accordance with S.C. Code 1976, §§ 56-5-5810—56-5-5950, provisions of which are adopted by reference.

    (b)

    It is unlawful for any person, within the Town of Ware Shoals, to deposit, leave, park, abandon, keep or allow to be kept on any premises within the town limits or upon any town street, way or alley, any motor vehicle not having a valid or current license plate and/or registration for said vehicle or to keep or allow to be kept any vehicle which has been dismantled or which is inoperable and is not maintained so that it may be operated on the town streets, except when said vehicle is being repaired at a garage having a business license issued by the town or when said vehicle is being repaired at the residence of the owner of the vehicle. If the motor vehicle does not have a valid registration or license tag; it shall be presumed that the vehicle has been abandoned. The only exception to this is a motor vehicle without a valid registration or license tag may be stored in an enclosed building at the residence of the owner. Enclosed building is defined as one with a solid roof, four walls and a door. Tarps covering abandoned motor vehicles will not be acceptable.

    (c)

    Upon notification by the town that said vehicle must be repaired, licensed, and/or removed the owner shall have 15 days to comply with the said notice. If such vehicle is not repaired, licensed and/or removed within that time, a town ordinance summons shall be served upon the owner requiring the owner to appear in the municipal court for the Town of Ware Shoals to answer for violation of the law within.
